These Terms of Service (“Terms”) govern access to and use of the software platforms provided by PetraMED, LLC (“PetraMED,” “we,” “our,” or “us”), including but not limited to policy management, chart review, and monitoring tools (“Services”). By accessing or using the Services, the user (“you” or “User”) agrees to be bound by these Terms.

1. Eligibility and Authorized Use

You may access the Services only if:

• You are an authorized representative of a partner organization or agency;
• You have been granted login credentials by PetraMED or your organization;
• You are at least 18 years of age and legally permitted to access sensitive or confidential health-related information.

2. User Responsibilities

By using the Services, you agree to:

• Keep your login credentials confidential and not share them with others;
• Access and use the platform only for authorized purposes;
• Refrain from attempting to reverse-engineer, interfere with, or compromise the security of the system;
• Comply with all applicable local, state, and federal laws including HIPAA, 42 CFR Part 2, and others relevant to your role.

PetraMED reserves the right to suspend or revoke access for any violation of these Terms.

3. Privacy and Data Security

PetraMED handles all data in accordance with applicable privacy regulations. For more information, please see our Privacy Policy.

• All Protected Health Information (PHI) and personally identifiable information (PII) processed through the platform is encrypted in transit and at rest.
• Audit logs are maintained to monitor access and modification of records.
• PetraMED does not sell or distribute user or agency data to third parties.

4. Platform Availability and Support

We strive to ensure the Services are available 24/7, excluding planned maintenance and unexpected outages. While we take reasonable measures to provide stable service, PetraMED does not guarantee uninterrupted access.

5. Intellectual Property

All software, content, and documentation provided through the Services are the intellectual property of PetraMED, LLC or its licensors. You may not copy, reproduce, republish, or distribute any portion of the Services without express written permission, except where permitted for official use.

6. Limitation of Liability

To the maximum extent permitted by law:

• PetraMED shall not be liable for any indirect, incidental, or consequential damages arising out of or related to the use of the Services;
• PetraMED’s total liability shall not exceed the amount paid for Services in the preceding 12 months.

7. Termination

PetraMED may suspend or terminate your access at any time if:

• You breach these Terms;
• Your organization discontinues use of the Services;
• Continued access would pose a security, privacy, or operational risk.

8. Modifications

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Continued use of the Services after such changes constitutes your agreement to the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
